Please read these Terms of Use carefully. They create a legally binding agreement between us.
Our Data Protection Policy is part of these Terms of Use.

These Terms of Use apply to (i) your access and use of the website hosted at TUVPN.COM and all associated sites linked to TUVPN.COM which are operated by SDN Systems Pte. Ltd (“Site”) and (ii) your use of and subscription to the virtual private network and proxy services available on the Site (“Services”). These Terms of Use apply regardless of whether you access the Site or use the Services on a computer, wireless or mobile device or any other technology or if you are a registered user or simply browsing the Site (“User”).

BY USING THE SITE AND/OR SUBSCRIBING TO THE SERVICES, YOU AGREE TO COMPLY WITH THESE TERMS OF USE. IF YOU DO NOT AGREE, DO NOT USE THIS SITE OR SUBSCRIBE TO ANY OF THE SERVICES.

1. Eligibility

By using the Site and/or subscribing to the Services, you confirm that:

1. you are aged 18 or over;
2. you are not prevented from using the Site or our Services by any law, court order or regulation which may apply within the jurisdiction from which you are accessing the Site;
3. all User registration information you submit is truthful and accurate and will be kept updated.

In order to access the Services, we may require you to register and provide a unique username and password.

Please note that, in order to comply with laws in certain jurisdictions, we are obliged to limit certain aspects of the Services available to users in those jurisdictions.

2. Changes to these Terms of Use

These Terms of Use, the Services and the Site may be changed from time to time through the publication of updates.

Specifically;

• We may add to the list of Prohibited Activities from time to time.
• We may decrease or increase the price for the Services or make access to the Site subject to payment.
• We may change the Services or the Site from time to time. We will notify you if we make a change to the Services which you are being supplied with at the time we make the change.

We recommend that you check these Terms of Use regularly to ensure that you are aware of the most current obligations that apply to you. By using the Site and/or subscribing to the Services, you agree to comply with these Terms of Use, including any modification of them.

3. Prohibited Activities

We will not tolerate the use of the Services or the Site to encourage or undertake any illegal activity including without limitation the following: scams, fraud, theft, viruses, hacking, denial of service attacks, spam, transmission of child pornography, transmission of harassing, profane, obscene, libellous, defamatory or fraudulent content, transmission of content which promotes terrorism, racism, bigotry, hatred or physical harm against any individual, malware distribution, transmission of third party content (e.g. by way of peer to peer file sharing) unless you have the owner’s consent to do so, excessive use of the service or Site infrastructure, unsolicited marketing, identity theft, extortion, blackmail, threats and generally any other activity that may violate any applicable laws (“Prohibited Activities”).

If you feel that the Site or the Services are being used for any of the above Prohibited Activities, we strongly recommend that you notify us of the details at abuse@tuvpn.com. We will endeavour to investigate each complaint within a reasonable timescale.

You are responsible for any material which is transmitted by you using our Services and/or the Site. If you undertake or appear to be involved in any of the Prohibited Activities, or violate any other term of these Terms of Use, we may take action against you. This may include reporting you to relevant law enforcement agencies, or restricting or disabling your access to the Services and/or the Site.

NB: Before signing up, users should be aware that TUVPN.COM has enabled technical blocks on its VPN network to prevent all peer to peer (P2P) data transfers.

4. Trial Period

We will refund your money for the Services after the 7 day trial period subject to certain conditions. These are:

• You must not have generated more than 1GB of traffic from the date of recruitment / renewal of the Service.
• There must have been no more than seven days from date of recruitment / renewal of the Service.
• Your account must be fully paid up.
• You must not have undertaken any Prohibited Activities.

In other exceptional circumstances, we reserve the right to offer a refund on a non-precedential basis to certain Users as a gesture of goodwill.

5. Security

Our Services are designed to provide Users with a higher degree of anonymity and security when browsing the Internet. However, in the modern world, no service can be completely secure and we recommend that you maintain reasonable security protection (firewalls, back-ups, virus and spyware protection) to maximise security.

You must protect your username and password to the Site from unauthorised use and must not disclose it to any third party. You are responsible for all actions carried out on the Site or via the Services using your username and password. If we reasonably believe that there is a question about the identity of the person trying to access your account or an element of the Site, we may deny your access and/or use of the Site.

6. Data Protection

We act as an internet service provider and do not control the content of information passing through our systems. We do not normally monitor, record or store User activity, save where we are required to do so by law or to protect our legal position. We will however store e-mail addresses upon registration for the purposes of password recovery, IP addresses for the purposes of fraud control and the total traffic on our Services for the purposes of network optimisation.

7. Trademarks

The TUVPN name, “We are Your Virtual Shield” slogan and other logos and all related product and service names, designs and slogans on the Site are trade marks, copyright and service marks which are owned by or licensed to us. You may not use them in any way without our prior written consent.

8. Cancellation/Change to Service

You may cancel or change the period of your Service subscription at any time by selecting the “Cancel Service” option in your Client Area. Please note that if you have sufficient funds in your User account, your subscription to your chosen Service will automatically renew. If you do not have sufficient funds in your User account, your chosen Service will expire at the end of the subscription period.

You may change the type of your Service subscription (for example the usage levels on subscribed bandwidth) up to 3 days before your subscription expires.

9. Liability

We cannot guarantee uninterrupted access or an error free service at all times.

Our maximum aggregate liability to you relating to the use of the Services available on the Site will not exceed the total amount paid to us by you during the twelve months immediately preceding a claim.

We will also not be responsible for the following types of losses: indirect, special or consequential loss (i.e. losses which are not directly related to our breach), economic loss, loss of profits, revenue or goodwill, loss of data, losses as a result of any matter outside of our control, losses as a result of the actions of any other User of the Site and/or Services.

Our use of hyperlinks to third party sites is not an endorsement of those sites, nor does it incur any obligation or responsibility on our part. We do not check the content of third party sites.

We do not limit our liability for death or personal injury arising from our negligence, fraud or fraudulent misrepresentation.

If we suffer any losses due to your violation of these Terms of Use, you will pay to us any and all costs, damages or expenses which we suffer as a result of your acts.

10. Entire Agreement

These Terms of Use (including our Data Protection Policy) contain the entire agreement between you and us concerning your use of the Site and the Services and supersedes any and all prior or inconsistent agreements between us which relate to the same matter.

11. Governing Law

These Terms of Use are governed by and construed in accordance with English law. Any dispute (including non-contractual disputes) arising from these Terms of Use shall be subject to the exclusive jurisdiction of the English courts.
